Welcome to Sick Story. The terms "we", "us" and "our" refer to Sick Story LLC.
Sick Story LLC operates this online store and website, including the associated content, features, products and services (collectively, the "Services"). Our store is powered by Shopify.
These Terms of Service ("Terms") govern use of our Services and purchases of our products.
By using our Services or placing an order, you agree to these Terms and the policies published on our website.

To purchase dietary supplements from Sick Story LLC, you must be at least 18 years old.
Other statutory age requirements may apply to products that are not dietary supplements.
Certain features or placing an order may require information such as your email address, billing address, payment information and delivery address.
You confirm that all information you provide is accurate, current and complete and that you are authorized to use it.
You are responsible for the security of your login credentials and all activity through your customer account. Customer accounts may not be sold, transferred or shared with others without our consent.

However, colors, appearance, packaging, labels or other visual features may differ from the depictions on our website, for example due to different displays, production changes, supplier changes or packaging updates.

We reserve the right to discontinue products, limit quantities or restrict sales or shipping of certain products to particular people, regions, states or jurisdictions.
Certain dietary supplements may be unavailable in some regions due to legal regulations, requirements of individual US states or restrictions imposed by our fulfillment partners.
Dietary supplements are currently not shipped to Alaska or Hawaii .
Certain dietary supplements may also be excluded from sale or shipping in New York or other jurisdictions .
Availability shown at checkout is subject to these restrictions.
SECTION 3 – ORDERS
By placing an order, you make an offer to purchase the selected products from Sick Story LLC.
To the extent permitted by law, we reserve the right to accept, decline, limit or cancel orders.
An order is accepted only after it has been confirmed and payment has been processed successfully.
Please review your order carefully before submitting it.
Because many of our products are produced, prepared or forwarded to fulfillment partners immediately after an order is received, we may no longer be able to make changes or cancellations once processing has begun.
If we decline, change or cancel an order, we will try to notify you using the contact information you provided.
Returns, refunds, replacements and exchanges are governed by our Return and Refund Policy.
Our products are generally intended for personal or private use. Unauthorized commercial resale or export is not permitted.
SECTION 4 – PRICES AND PAYMENT
Prices, discounts, promotions and product availability may change at any time.
Generally, the price shown when you place your order applies, subject to obvious pricing or display errors and applicable law.
Unless expressly stated otherwise, additional taxes, shipping costs, handling fees, customs duties or other government charges may apply.
You agree to provide complete and accurate billing, payment and account information.
You confirm that you are authorized to use the payment method you provide.
We reserve the right to correct pricing or billing errors and, to the extent permitted by law, cancel affected orders. Payments already made will be refunded in accordance with legal requirements.
SECTION 5 – SHIPPING AND DELIVERY
Stated shipping and delivery times are estimates, not guaranteed delivery dates.
To the extent permitted by law, Sick Story LLC is not liable for delays caused by carriers, fulfillment partners, weather, customs clearance, incorrect or incomplete delivery information supplied by the customer or other circumstances beyond our reasonable control.
Products shipped through different fulfillment partners or warehouses may arrive in separate packages.
Shipping availability may vary by product and delivery location.
Certain dietary supplements cannot be shipped to all US states or jurisdictions.
To the extent permitted by law, ownership and risk of loss pass to the customer when the products are handed to the carrier, unless applicable law requires otherwise.
SECTION 6 – INTELLECTUAL PROPERTY
The Services, including trademarks, logos, text, graphics, images, video, audio, designs, product content and their selection and arrangement, are owned by Sick Story LLC or used by us lawfully and are protected by applicable intellectual property laws.
Our Services may be used for personal, non-commercial purposes only.
Content from our Services may not be reproduced, distributed, modified, published, sold, publicly displayed, stored, transmitted or otherwise commercially used without prior express consent from Sick Story LLC.
These Terms transfer no ownership or license rights in intellectual property belonging to Sick Story LLC, Shopify or other third parties.
All rights not expressly granted are reserved.

Such services may be provided on an "as available" and "as is" basis.
To the extent permitted by law, Sick Story LLC makes no warranty about the functionality, availability or content of third-party tools or services.
Their use may also be subject to the relevant third party's terms and privacy policies.
New features, tools or services offered through our website in the future may also be subject to these Terms.

Sick Story LLC does not control such third-party offerings and assumes no responsibility for their content, accuracy, availability, security or business practices.
When you use a third-party website or service, that provider's terms and policies apply.
This section does not limit any mandatory statutory responsibility of Sick Story LLC for products purchased directly from Sick Story LLC.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Sick Story LLC uses Shopify for the technical provision and operation of parts of our online store.
All purchases made through our store are concluded between you and Sick Story LLC , not Shopify.
To the extent permitted by law, Shopify is not responsible for products sold by Sick Story LLC or for claims, damage or losses arising from transactions between you and Sick Story LLC.
Mandatory statutory rights and claims remain unaffected.
SECTION 10 – PRIVACY
The collection, use, sharing and processing of personal information are governed by our website's Privacy Policy.
Because our store is powered by Shopify and we may use additional service providers, certain personal information may also be processed by Shopify or other providers.
This may include payment processing, order fulfillment, shipping, analytics, marketing or customer support.

SECTION 11 – REVIEWS AND FEEDBACK
If you submit reviews, comments, ideas, suggestions, images, testimonials or other content to Sick Story LLC ("Feedback"), you grant Sick Story LLC a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to use, reproduce, adapt, publish, distribute and display that Feedback in connection with operating, improving and promoting our Services.
You confirm that you hold the necessary rights to submitted content and that it does not infringe third-party rights or applicable law.
If you received compensation, a discount, a free product or another benefit in connection with a review or recommendation, you must disclose it where required by law.
We reserve the right to remove content that we reasonably consider unlawful, misleading, offensive, infringing or otherwise inappropriate.

To the extent permitted by law, we may restrict or terminate your access to our Services if you breach these Terms or engage in conduct that could harm Sick Story LLC, Shopify, our service providers or other users.
Termination does not affect obligations or claims that arose previously.
Provisions that by their nature should survive termination remain in effect, including those on intellectual property, disclaimers, limitations of liability, indemnification, governing law and outstanding payment obligations.

SECTION 16 – LIMITATION OF LIABILITY
TO THE EXTENT PERMITTED BY APPLICABLE LAW, Sick Story LLC and our owners, directors, employees, affiliates, agents, contractors, fulfillment partners, service providers and licensors are not liable for indirect, incidental, special, exemplary, punitive or consequential damages.
This includes lost profits, lost revenue, lost savings, data loss, business interruption or replacement costs arising from using our Services or purchasing or using our products.
These limitations apply whether claims are based on contract, tort, negligence, strict liability or another legal basis.
To the extent permitted by law, Sick Story LLC is also not liable for loss or damage caused by events beyond our reasonable control.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.

To the extent permitted by law, you agree to indemnify Sick Story LLC, our affiliates, directors, employees, agents, contractors, licensors, service providers and Shopify against third-party claims, liabilities, damages, losses and reasonable legal costs arising from:

- your infringement of third-party rights, or
- your unlawful or unauthorized use of our Services.
To the extent permitted by law, we reserve the right to participate in or assume the defense of such claims.
SECTION 18 – SEVERABILITY
If any provision of these Terms is wholly or partly unlawful, invalid or unenforceable, it will apply to the fullest extent permitted by law.
Where necessary, the invalid part will be severed from the remaining Terms.
The validity of the remaining provisions is unaffected.
SECTION 19 – WAIVER AND ENTIRE AGREEMENT
If Sick Story LLC does not enforce a right or provision of these Terms, or does not do so immediately, this does not constitute a waiver of that right.
These Terms, together with the policies expressly incorporated, form the agreement between you and Sick Story LLC regarding use of our Services.
They replace prior agreements or communications about the same subject.

We may update or change these Terms from time to time.
The current version is published on this page.
We will notify you of material changes where required by applicable law.
Changes take effect at the time stated in the updated version.
They do not retroactively change rights arising from completed transactions unless legally permitted or required.
